[ARCHIVED] Notice for the Amendment of the Greenham and Crookham Common Commission Scheme

The Greenham and Crookham Common Act 2002 ("the Act") is an Act to restore land at and in the vicinity of Greenham and Crookham Commons and came into force on the 1 May 2002 and under Section 7 of the Act it was deemed that a Commission should be constituted and called The Greenham and Crookham Common Commission ("the Commission") for the purposes of exercising functions under the Act.

It was set out in the Act s7 (2) that the Commission would consist of twenty members of whom the following would be appointed:

  • three from West Berkshire District Council ("the council")
  • one from Greenham Parish Council
  • one from Thatcham Town Council
  • one from Newbury Town Council
  • one from English Nature (now Natural England)
  • one from the Greenham Common Community Trust Limited
  • two from the Central Council of Physical Recreation (now known as The Sports and Recreation Alliance)
  • ten to be elected by the Commoners in the manner provided under Part 2 of Schedules 1 and 2 of the Act

Under Part 6 section 30 of the Act, the council may make a scheme altering the Constitution of the Commission after consultation with the Commission if one of the appointed bodies requests to be discharged from the Commission and the council may alter the Constitution by the removal of the member or members appointed to the Commission, and further the council may make such other provision altering the Constitution as the council thinks necessary.

The scheme may under Part 6 section 30 make a new provision in place of section 7 (2) a to h.

The council has agreed to release The Sports and Recreation Alliance and have accepted nominations from the Mid West Berkshire Local Access Forum and the West Berkshire Heritage Forum to become members of the Commission.  The Commission have agreed to accept the nominations.  The Commission Constitution with therefore become:

  • three from West Berkshire District Council
  • one from Greenham Parish Council
  • one from Thatcham Town Council
  • one from Newbury Town Council
  • one from Natural England
  • one from the Greenham Common Community Trust Limited
  • one from the Mid and West Berkshire Local Access Forum
  • one from the West Berkshire Heritage Forum
  • ten to be elected by the Commoners in the manner provided under Part 2 of Schedules 1 and 2 of the Act

Written representations from any interested party or parties can be made within 42 days from the date of this notice. The council will consider any representation made within this timescale and either withdraw the Scheme, make modifications to it, or will apply to the Secretary of State for confirmation of the Scheme.

What we did

We have now made an application to the Secretary of State for confirmation of the Scheme. Once the Scheme has been confirmed any relevant information will be published on the Greenham and Crookham Commons Commission website.
