Review of our Statement of Gambling Principles

The Gambling Act 2005 (section 349) requires us to review our statement of gambling principles every three years. The statement sets out the principles that the licensing authority proposes to apply when exercising their functions under the Gambling Act. All comments will be considered and used to help shape the final statement, which will be considered at the Full Council meeting on 6 December 2018.

NB: The Gambling Commission Guidance advises that demand for gambling premises and morality issues are not considerations under this legislation. Therefore the authority may not be in a position to consider any comments of this nature.


What you told us

We received six responses. The comments made were mostly around further changes, rather than on the proposed amendments.

What we did

The statement of gambling principles was considered in great detail and a number of typographical and grammatical changes were made to the document. It was felt that in the most part, the comments raised by those who submitted consultation responses had been addressed through the re-drafting of the document. Other notable amendments:

  • a reference was added under section 2.4 to the West Berkshire Health and Wellbeing Board and Safeguarding Adults Board in relation to vulnerable persons
  • an amendment was made to section 1.3 in relation to the duties of the authority, from ‘promoting the licensing objectives’ to ‘having regard to the licensing objectives’
  • clarifications were made under section 2.5 to confirm that additional conditions would only be added where they are needed

A report was submitted and a decision made at the Full Council Meeting on 6 December 2018.
