Advice for Private Landlords and Tenants

Advice about private sector renting and dispute resolution

Both landlords and tenants have legal rights and responsibilities.

Tenancy agreements are legally binding contracts, but they must be in line with laws that relate to landlords and tenants.  Our pdf icon Guide to Renting Privately [222kb] helps to explain the process and answers a number of common questions tenants may have.

Tenancy-related Issues

West Berkshire Council Housing Service works with both landlords and tenants to make eviction the last course of action in the event of issues arising.

This may mean support for the tenant with their housing benefit claim, requesting direct payments, offering advice on disrepair issues or in some cases explaining to the tenant the potential consequences of their behaviour on their tenancy, and their future housing options.

If you're a tenant and your landlord doesn't live with you, they cannot evict you without giving you a set period of notice and seeking a possession order from the courts.
If you've been served notice to leave by your landlord, you should contact us for advice about your future housing options, and to make sure that the notice is legally valid.
